Suspended attorney Brian K. Kohn again under investigation

A Billings attorney who has twice been suspended by the Montana Supreme Court is under investigation again for misconduct.
Brian K. Kohn is accused of six counts of violations of professional misconduct, including committing criminal perjury or false swearing and failing to return unearned fees to a client.
Kohn was most recently suspended for seven months starting Sept. 1, 2016. He was still under suspension when the Office of Disciplinary Counsel filed the most recent complaint against him in April 2017.
In his response to the current complaint, Kohn denies all misconduct allegations. A hearing was held before the Commission on Practice on Oct. 13, 2017. The Montana Supreme Court has not yet ruled on the allegations.
