Supreme Court denies disbarred Hamilton attorney's petition for rehearing

The Montana Supreme Court has denied a disbarred Hamilton lawyer's petition for a rehearing of his disciplinary case.

The court ruled that Myers failed to file any objections to the Commission on Practice's findings, conclusions, and recommendations.

In the order, signed by all seven justices, Chief Justice Mike McGrath wrote that the U.S. Supreme Court has not, as Myers suggests, "given First Amendment carte blanche protection to false statements by and about judicial candidates and lawyers in the context of judicial elections." 

Myers told the Ravalli Republic in December that he planned an appeal to the U.S. Supreme Court. The paper also reported that Myers has filed suit with the Ninth Circuit Court of Appeals that Montana's disciplinary rules are unconstitutional because they violated his right to free speech.
