The importance of data security and privacy grows every day. With this in mind, attorneys should have a solid understanding of the types of IT vendor contracts that exist and how to negotiate contract language that reduces liability exposure, complies with applicable regulatory requirements and best protects the confidentiality, integrity and availability of their clients’ data. Peter Arant and Stephen Kreitner will discuss recent data breaches, describe the common types of IT vendor contracts, the related information security and privacy risks, relevant state and federal regulatory requirements, and the types of contractual provisions that should be considered when advising a health care or business client.
Who are the speakers?
Peter Arant is an attorney based in Missoula. His practice focuses on information security, privacy, and technology.
Stephen A. Kreitner is Associate General Counsel for Kalispell Regional Healthcare, a 300-bed health care system located in Kalispell, Montana. Steve’s practice focuses generally on the operational, business and regulatory issues that affect healthcare providers. In particular, Steve is responsible for the review and negotiation of information technology and managed care/third party payer agreements; representing KRH in Montana Medicaid appeals before the DPHHS Office of Fair Hearings; and providing counsel on a variety of state and federal regulatory compliance issues, including HIPAA and information security and privacy issues.
Peter counsels clients regarding HIPAA, as well as other state and federal laws relating to privacy and security. He helps clients take proactive measures to comply with these laws and to reduce their liability exposure. This includes assisting with risk assessments, developing policies and procedures, drafting and reviewing contracts, and more.
Peter also represents a variety of technology companies. He provides assistance with software licensing and other tech transactions. Additionally, he advises software developers and other tech companies whose products will use or access sensitive data.
Steve currently is Vice Chair of the State Bar of Montana Health Care Law Section.
Previously, Steve worked for the Center for Internet Security from 2003 to 2012 in various roles, including General Counsel & Corporate Secretary, Director of Administrative Services and Member Relations, and Deputy Director of the CIS Security Benchmarks Division. From 1997 to 2002, Steve was Director of Risk Management and the Administrator of the Institutional Review Board at Florida Hospital, a 7-campus, 2,000-bed hospital system in Orlando, Florida. Prior to working for Florida Hospital, Steve worked as a professional malpractice and general liability claims attorney for Adventist Health System in Orlando, Florida.
Steve earned his J.D. at the University of Baltimore School of Law in 1992. During his time at the School of Law, Steve earned the American Jurisprudence Award in Commercial Transactions and the ABA Outstanding Performance Award in Land Use and Local Government. Steve earned a B.A. in History with a minor in Religion at Southern Adventist University in 1989.
