Court hears dispute over FWP conservation easements

The Montana Supreme Court heard oral argument in a disagreement over who has authority to approve Montana Fish, Wildlife & Parks conservation easements.
The dispute centers on whether the $6.1 million Horse Creek Conservation Easement near Wibaux is a "land acquisition" requiring approval of the State Land Board. Gov. Steve Bullock concluded that it did not, and the state closed on the deal without board approval. Attorney General Tim Fox concluded in a formal opinion that it did.
