Comment sought on proposed Rules of Professional Conduct overhaul

The Montana Supreme Court has ordered a 90-day comment period on a comprehensive proposed overhaul of the Montana Rules of Professional Conduct. The overhaul would revise 18 rules of the MRPC  and a portion of its preamble.

The State Bar of Montana's Ethics Committee examined the 29 Montana rules differ from the American Bar Association's Model Rules. Of those 29, the bar recommends keeping 10 unique Montana rules as currently adopted; amending 11 rules to directly or closely correspond with ABA Model Rules; amending seven unique Montana rules to add ABA language;rejecting one ABA rule entirely; and including one unique addition to the preamble.

The committee began its review, the first comprehensive review of the Montana Rules since 2004, in April 2017.

Bar members or other members of the public who would like to comment must do so in writing to the Clerk of the Montana Supreme Court by June 5, 2019.
