The Senate has voted to confirm a former Montana solicitor general and Montana Supreme Court candidate to the U.S. Court of Appeals for the Ninth Circuit.

The vote makes Lawrence VanDyke the 10th of President Donald Trump’s nominees on the Ninth Circuit nation’s largest appellate court. He is the president’s 50th appointee to the 12 federal circuit courts.

In a 51-44 vote, the Senate on Wednesday confirmed VanDyke, whose nomination had been the source of bitter partisan debate.

Earlier this year VanDyke was named deputy assistant attorney general for the U.S. Department of Justice's Environment and Natural Resources Division. He served as Montana solicitor general from 2013-2014. In 2014 he ran an unsuccessful campaign for Montana Supreme Court against incumbent Justice Mike Wheat, after which he left Montana to become Nevada solicitor general from 2015-2019.

He received his Juris Doctor from Harvard Law School in 2005.

VanDyke was nominated to replace Judge Jay Bybee, who is assuming senior status on Dec. 31.
