The judges of the First Judicial District have vacated all civil and criminal jury trials scheduled to begin on or before May 1, 2020, in response to the COVID-19 emergency.
The action is one of several measures addressed in an order issued on Thursday, March 18. The order asserts that, asserted criminal speedy trial violation purposes, any delay attributed to the order should be charged to the state as "institutional delay."
The order allows for non-jury proceedings and any other in-court appearances may be held at the presiding judge's discretion.
The First Judicial District covers Lewis and Clark and Broadwater Counties.
Several other judicial districts are expected to release similar orders. This post will be updated as more information is available.
