The Montana Supreme Court has issued an order inviting members of the bench and bar, as well as other interested persons, to submit comments on proposed amendments to the Montana Rules of Evidence. The proposed revisions address Rules 106, 612, 803(6), 804(b)(6), and 901, including provisions related to refreshing witness recollection, business records, forfeiture by wrongdoing, and authentication of evidence potentially created or altered by generative artificial intelligence.
Comments must be filed with the Clerk of the Montana Supreme Court within 90 days of the Court’s May 18, 2026 Order. The full Order and proposed revisions are available here.
